Genfer Roma-Bettler aus Haft entlassen

Die Mitte 2007 u. a. von Journalisten und Rechtsanwälten gegründete Roma-Hilfsorganisation Mesemrom, die sich für die Interessen der Roma in Genf einsetzt, hat Mitte dieses Monats als Vertretung einer rumänischen Romni vor Gericht in zweiter Instanz einen Sieg errungen. Nun müssen Tausende von Geldstrafen annulliert werden, die seit 2008 gegen Roma-Bettler verhängt wurden. Mehrere Roma, die Freiheitsstrafen abzusitzen hatten, weil sie die Bußgelder nicht aufgebracht hatten, sind daraufhin umgehend aus der Haft entlassen worden.
Die Genfer Polizei hatte die Namen bettelnder Roma vor dem Hintergrund des im Kanton Genf seit Februar 2008 herrschenden Bettelverbots rechtswidrig im Amtsblatt publiziert und die unübliche Veröffentlichung der Daten mit dem Argument begründet, dass die betreffenden Personen keinen festen Wohnsitz hätten. Dieses die Persönlichkeitsrechte der Betroffenen verletzende Vorgehen, erläuterte Dina Bazarbachi, Präsidentin der Roma-Organisation, gegenüber der Presse, war jedoch gesetzwidrig, weil auf den rumänischen Identitätsausweisen sehr wohl auch die Anschrift vermerkt ist.
Schon im Juni brachte die Organisation den Fall einer inhaftierten rumänischen Bettlerin vor Gericht und konnte aufgrund der genannten Rechtswidrigkeit einen Sieg erreichen und die Enthaftung der Romni durchsetzen, die ihre Bußzahlung (Verstöße gegen das Bettelverbot können mit bis zu 100 Franken bestraft werden) nicht bezahlt und deswegen eine Freiheitsstrafe erhalten hatte. Kurz vor den Feiertagen bestätigte nun das Gericht in zweiter Instanz das bereits gefällte Urteil. Fünf Personen mussten deshalb laut Angaben von Mesemrom sofort freigelassen werden. Zudem betont die Roma-Hilfsorganisation, dass jene Roma, die eine Freiheitsstrafe verbüßen mussten bzw. deren Namensnennung im Amtsblatt rechtswidrig erfolgt war, Anspruch auf Entschädigung haben.
